Membership Rules & Regulations
Services: The Membership entitles the usage of Dogwood Country Club facilities and all equipment & services available for the entire duration of the Membership therein for lesson taking (if applicable), practice, play, entertainment of guests, business meetings, networking functions, events, and special requests approved by Management. The Membership herein gives access to all Dogwood Country Club locations, both presently available and those to become available in the future for the entire duration of the Membership.
Satisfaction Guarantee: Up to 3 days following the start of the Membership, the Member can cancel his/her Membership without penalty, and will be reimbursed in full, less any applicable initiation or evaluation fees.
Membership: The Membership is personal, and cannot be shared unless otherwise stated in the Agreement.
Appointments: Dogwood Country Club Members receive the benefit of booking appointments up to 30 days in advance.
Cancellation Policy: Dogwood Country Club observes a 24 hour cancellation policy for all appointments. Should the Member cancel inside the 24 hour period for any reason other than illness or medical emergency, he/she will be subject to a fee of 50% of the hourly rental. Should the Member cancel outside of the 24 hour period, he/she will incur no additional fees.
No-Show: Should a Member no-show an appointment for any reason other than illness or medical emergency, and neglect to provide any prior notice to the Club or Management, he/she will be subject to a fee of 100% of the hourly rental, billed at a reduced member only rate.
Member Account: Each Member will be required to keep a card on file to establish a Member Account at Dogwood Country Club. This account will post charges as they accrue daily, and the account will also be responsible for capturing any monthly fees agreed upon per the Contract. The Member reserves the right to change the card at any point during the Membership with written or verbal notice to the Club, but must maintain an active card on file for the entire duration of the Membership.
Tabs & Gratuity: All Member tabs left open for food and beverage charges will be subject to an automatic 20% gratuity.Â
Age Limit: The Member confirms that he/she is 18 years old or older. For persons less than 18 years old, exceptions are granted based on a written parental consent.
Code of Conduct: The Member shall respect the behavioral and operating principles and follow them on all occasions. This includes, but is not limited to:
⢠Wearing appropriate clean clothing and shoes at all times on property
⢠Behaving in a friendly and respectful manner towards the other Members and guests of the Club as well as the staff
⢠Maintaining a respectful dialogue and refraining from uttering or participating in obscene, discriminatory, or distasteful language
Guests of Members: The member shall be held responsible for the behavior and conduct of his or her guests at the club at all times including but not limited to:
⢠Wearing appropriate clean clothing and shoes at all times on property
⢠Behaving in a friendly and respectful manner towards the other Members and guests of the Club as well as the staff
⢠Maintaining a respectful dialogue and refraining from uttering or participating in obscene, discriminatory, or distasteful language
Suspension/Termination of Membership: If the Member behaves in a way that breaches the code of conduct, interferes or disturbs other Members or staff, or that the management considers inappropriate, the Membership can be suspended or terminated at Managementâs sole discretion. If the Member does not pay the Membership fees, the Membership can be suspended or terminated at Managementâs sole discretion. The payment duty remains until the original Contract period ends.
Lost Property or Theft: Dogwood Country Club claims no responsibility for loss or theft of any personal belongings, even if locked in a locker.
Access & Security: Dogwood Country Club is open and accessible to Members and guests in accordance with the hours posted on the website and / or the front door. For their own safety, and for the safety of the staff, the Member agrees to video and audio surveillance in Dogwood Country Club facilities.
Payment: The Member commits to paying the Membership fees in full, whether up front or monthly, for the full term of the agreed upon Membership duration per the Contract. The Member is responsible for all payments, whether up front, or in the case of automatic debits to the card on file. If the payment is late or declined, the access to the club will be blocked until the payment reaches Dogwood Country Club. If after 45 days the applicable debt is still not paid, the Member is in violation of the Contract and the total outstanding amount of the Contract will be due before the Membership is able to be re-instated. At 90 days past due, Dogwood Country Club reserves the right to transfer the collection efforts to a debt agency. The Membership charges will continue to accrue during any period of non-payment(s), or collections. As soon as the debts are paid in full, the access will be granted again to the club. Dogwood Country Club will send reminders by email. In the case that the email reminders are not received, it does not remove the responsibility from the Member to pay on time.
Renewal & Termination: All annual Contracts are signed for a 12-month period and semi- annual Contracts are signed for a 6-month period. Prior to the end of the Contract period, Members have the option to renew or upgrade at 5% off the current posted rates, and have up to 7 days to do so following the original Contract end date. If they choose to downgrade or terminate their Membership, or fail to renew within 7 days of the original Contract end date, there will be no discount honored on a future purchase. Members have the option to cancel any new Membership at no charge (less any initiation or evaluation fees) within 3 days of purchase. No termination is accepted beyond this date. Dogwood Country Club will send a notice via email (in advance at 1 month, and again at 2 weeks) prior to the end of the Contract period. Renewing a Membership will be at the sole discretion of the Member, and verbal/written notice is required. At the renewal, Members must endorse a new Membership Contract, of which will go into effect immediately following the date of signature unless otherwise specific on the Contract.
Frozen Membership: It is possible to freeze the Membership for i) medical reasons, upon presentation of a medical certificate, or ii) military service, upon presentation of the official call to duty. The Membership can be put on hold for minimum of 1 month and maximum of 6 months (9 months for pregnancy/childbirth), after which the Membership is automatically reactivated and any applicable Membership charges will resume. The Membership cannot be frozen in retrospect.
Transfer of Membership: An annual Membership (12-months) can be transferred. 6-Month Memberships cannot be transferred. Special Memberships cannot be transferred. To complete the transfer, the departing Member needs to share the intent of, and identify the new Member to Management. The new Member must accept the Terms & Conditions, and endorse a new (and if applicable) prorated Membership Contract. The new Member then assumes the Membership with the same conditions as per the original Contract. All transfers must be presented to Management, in writing, at least 30 days prior to the proposed transfer date.
Termination Exceptions: A cancellation is exceptionally granted if the Member leaves the country, or moves to a location in which exceeds a 30 minute commute to the nearest Dogwood Country Club facility. Official documentation of the move may be requested, at the discretion of Dogwood Country Club MGMT. An additional exception may be granted upon illness or
health circumstances preventing the member from participating in sport or activity. Official documentation from a licensed physician may be requested, at the discretion of Dogwood Country Club MGMT.
Early Termination: If a member chooses to terminate his or her membership early and / or outside of the parameters set forth under the âtermination exceptionâ in this contract, he or she is responsible for an early termination fee that will be equal to the cost of two monthâs membership fees.
Initiation: There are no current sign-up or initiation fees at Dogwood Country Club. A returning Member who does not hold a currently valid Membership is considered a new Member. A Member can change from one type of Membership to another without new initiation fees (if applicable) as long as the Memberships succeed one another.
Price Changes: All prices are fixed for the duration of the Contract. A price change can be implemented for the prolongation of a Contract or at the renewal period of a Contract. In such cases, the price change is communicated via email 1 month before the effective date.
Communication: Dogwood Country Club communicates by email and phone. Dogwood Country Club declines all responsibility if the email address or phone number doesnât exist, is wrong, or for whatever reason emails or calls do not arrive to the Member.
Health: The Member confirms that he/she does not suffer from health problems that would hinder participating in sport, exercise, strenuous athletic activity, or prevent him/her from engaging in sport, exercise, strenuous athletic activity, or that would be detrimental or adverse to the Memberâs health, safety or physical condition if he/she did participate. In case of any doubt, the Member shall seek advice by a medical doctor who should confirm the ability to participate. Dogwood Country Club shall have no obligation to perform a fitness assessment or similar testing to determine the Memberâs physical condition. If an assessment is done at Dogwood Country Club, it is for the sole purpose of compiling comparative data in order to track the Memberâs progress in a program and not for health diagnostic purposes.
Insurance: The Member confirms that he/she holds the necessary insurances to cover any accident or training incident. Dogwood Country Club shall not be subject to any claim, demand, or injury whatsoever with regard to the assessment of the Memberâs health condition or for any injury arising out of the Memberâs disability, impairment or ailment.
Liability: Each Member of Dogwood Country Club shall be liable for any property damage to Dogwood Country Club and /or personal injury caused by the Member or the Memberâs guests while on Dogwood Country Club premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.
Waiver of Liability: Any and all use of Dogwood Country Club facilities shall be at Memberâs own risk at all times. The Member, and any guests of the Member, shall not utilize the facility or any training device unless he/she knows the correct usage of the equipment or training device. Dogwood Country Club shall not be liable for any injuries, physical impact or damages to the Member or his/her guests, or the property of the Member or his/her guests, or be subject to any claim arising out of the use of the premises and/or training devices made available to the users.
Image & Likeness: The Member grants Dogwood Country Club the right to use his/her image or likeness in marketing efforts to support the growth initiatives of the club. The Member reserves the right to disallow the use of image & likeness, and must do so by presenting to Management a written notice of their intent and claim.
Court of Jurisdiction and Applicable Law: These Terms and Conditions and all matters arising out of or relating to the access to the Memberâs use of Dogwood Country Club premises and training devices shall be governed by the substantive laws of the state of North Carolina without regards to principle of conflicts of laws thereof. Any controversy, claim or dispute between the Member and Dogwood Country Club arising out of or relating to these Terms and Conditions and/or the Memberâs use of Dogwood Country Club premises and training devices shall be subject to the exclusive jurisdiction to the ordinary courts of the seat of the Company.
